Welcome to the Exercise Thresholds App (the "App" or "Service") operated by Felipe Mattioni Maturana - Software Development ("we," "us," or "our"). By accessing or using the App at https://www.exercisethresholds.com, you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, you must not access or use the App.

These Terms constitute a legally binding agreement between you and us. We may update these Terms from time to time, and your continued use of the App after such changes constitutes acceptance of the updated Terms.

The Exercise Thresholds App is an educational platform designed to help students, researchers, and professionals learn about and analyze exercise physiology data, particularly:

• Lactate threshold (θ_LT) and respiratory compensation point (RCP) detection
• Gas exchange and ventilatory parameters analysis
• Exercise testing data interpretation

The App provides the following features:

• Practice Cases: Pre-loaded datasets for learning threshold detection
• Custom Data Upload: Upload and analyze your own exercise physiology datasets
• Oxynet AI Analysis: Deep learning-assisted threshold detection
• PDF Report Generation: Generate professional analysis reports
• Exam Feature: Create and participate in practice exams for educational purposes
• Interactive Visualizations: View and analyze data through charts and graphs

• Clinical diagnosis or patient care
• Medical treatment decisions
• Prescribing exercise programs for patients
• Replacing professional medical advice, diagnosis, or treatment
• Any life-critical or emergency situations

No Medical Advice: The information, analyses, and outputs provided by the App do not constitute medical advice. Always seek the advice of a qualified healthcare provider with any questions regarding medical conditions or exercise prescriptions.

Research Use: While the App may be used in research contexts, any results or analyses generated should be validated through appropriate scientific methods before publication or application.

By using the App, you represent and warrant that:

• You are at least 16 years of age (or the age of legal majority in your jurisdiction)
• You have the legal capacity to enter into these Terms
• You are using the App for educational, training, or research purposes
• You will comply with all applicable laws and regulations

You may use the App for the following purposes:

• Educational Learning: To learn about exercise physiology concepts and threshold detection methods

You agree NOT to use the App for any of the following:

7.1 Your Responsibility

When you upload exercise physiology data to the App, you represent and warrant that:

• You have the right to upload and use the data (you own it or have permission)
• The data does not contain personally identifiable information (names, dates of birth, etc.)
• The data complies with all applicable privacy laws and regulations
• You have obtained all necessary consents for research data

7.2 License to Your Content

You retain all rights to the data you upload. However, by using the App, you grant us a limited, non-exclusive license to:

• Process your data to provide the App's features
• Temporarily store data as necessary for PDF generation and Oxynet analysis

Important: As stated in our Privacy Policy, your uploaded data is:

• Processed primarily in your browser (client-side) and never leaves your device for most features
• Sent to servers only for PDF generation, Oxynet analysis, or exam features
• Immediately deleted after processing (not stored or used for AI training)
• Exam data is automatically deleted 30 days after the exam ends

8.1 Our Rights

The App, including its software, user interface, graphics, content, and documentation, is owned by Felipe Mattioni Maturana - Software Development and is protected by copyright, trademark, and other intellectual property laws.

All rights not expressly granted to you in these Terms are reserved by us.

8.2 Academic Use and Citations

If you use the App for research or publish results that involved the App's analyses, please cite the App appropriately in your work. We may provide citation guidelines on our website.

8.3 Practice Case Data

The practice case datasets provided in the App are for educational use only and may not be republished or redistributed without permission.

• Accuracy: We do not warrant that the App's analyses, calculations, or outputs are accurate, complete, or error-free
• Availability: We do not guarantee uninterrupted or error-free operation of the App
• Fitness for Purpose: We make no warranty that the App will meet your specific requirements
• Security: While we implement security measures, we cannot guarantee that the App is free from viruses or other harmful components

You acknowledge that exercise physiology analysis involves complexity and interpretation, and that automated or AI-assisted analyses may contain errors or require expert validation.

This limitation applies to:

• Errors or inaccuracies in analyses, calculations, or reports
• Any decisions made based on information from the App
• Loss or corruption of uploaded data (always maintain backups)
• Unauthorized access to or alteration of your data
• Service interruptions or technical issues
• Any other matter relating to the App

Free Service: Because the App is provided free of charge, you acknowledge that our liability is limited accordingly. You use the App at your own risk.

You agree to indemnify, defend, and hold harmless Felipe Mattioni Maturana - Software Development, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Data you upload that violates privacy laws
• Any medical or clinical decisions made using the App (which is prohibited)

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12.2 Terms Updates

We may update these Terms from time to time. When we do, we will update the "Last Updated" date. Material changes will be notified through the App or via email if we have your contact information. Your continued use of the App after changes constitutes acceptance of the updated Terms.

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Prohibited use of the App
• Fraudulent, abusive, or illegal activity
• Use that compromises the security or integrity of the App

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Germany.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
